It wasn't nailed down...

You can't take your "house, person, papers and effects" with you, but it seems you do get some kind of grace period.

A Ninth Circuit panel, despite including Jay Bybee, ruled in Mathis v. County of Lyon against a Nevada sheriff's deputy who claimed qualified immunity from suit after he took a dead man's property from his house, knowing meanwhile that the son of the deceased would be arriving the very next day.
